CIRCULAR

PROVISIONS OF THE ESTABLISHMENT AND EVALUATION, AND APPROVAL INSPECTION CERTIFICATION SCHEME FOR IMPLEMENTATION OF ENVIRONMENTAL PROTECTION DETAIL; ESTABLISHMENT AND REGISTRATION OF ENVIRONMENTAL PROTECTION SCHEME SIMPLE

MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to the Law on Environmental Protection November 29, 2005;

Pursuant to Decree No. 29/2011 / ND-CP of April 18, 2011 of the Government on strategic environmental assessment, environmental impact assessment, environmental protection commitments;

Pursuant to Decree No. 25/2008 / ND-CP of March 4, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment, which was amended and supplemented Decree No. 19/2010 / ND-CP of March 5, 2010 and Decree No. 89/2010 / ND-CP of August 16, 2010;

At the request of the Director General of Department of Environment, Department of Legislation,

RULES:

Chapter I

GENERAL PROVISIONS

Article 1 Scope

This Circular providing details about the formulation, appraisal and approval of environmental protection projects in detail; test and certify the implementation of environmental protection projects in detail; establishment and registration of environmental protection projects simply follow paragraph 6 of Article 39 of Decree No. 29/2011 / ND-CP of April 18, 2011 of the Government on strategic environmental assessment, impact assessment environment, commitment to environmental protection (hereinafter referred to as Decree No. 29/2011 / ND-CP).

Subject to Article 2

This Circular applies to all state agencies, organizations and individuals in the country and abroad (hereinafter referred to as organizations and individuals) involved in the preparation, appraisal and approval of projects environmental protection detail; test and certify the implementation of environmental protection projects in detail; establishment and registration of environmental protection projects simple.

Chapter II

ESTABLISHMENT AND EVALUATION AND APPROVAL OF ENVIRONMENTAL PROTECTION SCHEME DETAILS

Article 3 The establishment must establish environmental protection project details

1 Background to draw up plans to protect the environment details (hereinafter Facility) scale, equivalent properties to the object to report on environmental impact assessment prescribed in Clause 1, Article 12 Decree No. 29/2011 / ND-CP, including:

b) Basis has decided to approve the assessment report on environmental impact, while improving, expanding, increasing the capacity of the subjects to report on environmental impact assessment supplementation (prior to Decree No. 29/2011 / ND-CP effect) or subject to repeated reports of environmental impact assessment (as defined in Decree No. 29/2011 / ND-CP) but no decision approved report approved environmental impact assessment or additional approval decisions impact assessment report that the current environment has completed the renovation, expansion, increase capacity;

c) Basis has decided to approve the project environmental protection, certificate of registration of environmental protection projects, the renovation, expansion, increase capacity subject to reporting impact assessment environment, but there is no reported decision approving the environmental impact assessment which has now completed the renovation, expansion, increase capacity;

d) has a basis in the text: registration certificate of environmental standards, certification of registration of environmental protection commitment, certificate of registration commitments additional environmental protection , written notice of the refusal to register is committed to protecting the environment, while improving, expanding, improving capacity subject to reporting environmental impact assessment truongnhung no decision approving reports environmental impact assessment which has now completed the renovation, expansion, increase capacity;

e) establishment has decided to approve the project environmental protection detail when renovating, expanding, increasing the capacity of the subjects to report on environmental impact assessment, but no decision approving assessment of environmental impact which has now completed the renovation, expansion, increase capacity;

e) Facility has commenced and is in the preparation stage (site preparation), has completed the preparation stage and are in the construction phase but no decision approving impact assessment report environment or decision approving the environmental protection details.

2. basis specified in paragraph 1 of this Article shall make proposals for environmental protection regulations detailed in this Circular and submitted to the competent authority for evaluation and approval.

Article 4 The process of formulation, appraisal and approval of environmental protection projects detailed

Formulation, appraisal and approval of environmental protection projects shall comply with the detailed procedure in Appendix 1 to this Circular, including the following steps:

1. establishments specified in Article 3 of this Circular up, sent a dossier of request for appraisal and approval of environmental protection project details to competent authorities for approval specified in paragraph 1 of Article 7 of this Circular.

Article 5: Prepare, submit dossiers of request for appraisal and approval of environmental protection project details

Facility owner liable to draw up plans to protect the environment is responsible for the details:

1 Make or hire consultants to draw up plans to protect the environment in detail the structure and content specified in Appendix 2 to this Circular.

2 Send by mail or directly records appraisal scheme proposed environmental protection details to the competent authority for evaluation and approval provisions of paragraph 1 of Article 7 of this Circular. Profiles include:

a) A (01) written request for appraisal and approval of environmental protection projects detailed in the form prescribed in Appendix 3 to this Circular;

b) In (05) the environmental protection project details stapled, with cover and cover page in the form prescribed in Appendix 4 to this Circular and a (01) copies on a CD ;

c) One of the following documents: investment projects, feasibility study report of the facility or equivalent document in accordance with the law on investment (only on request basis points specified in f Clause 1 of Article 3 of this Circular).

Article 6: Consultation on proposals for environmental protection details

1. facility shall send the attached documents summarize the main contents of the proposal in detail the environmental protection in the form prescribed in Appendix 5 to this Circular to the People's Committee of the commune where the real current production, business and service establishments to apply for consultations.

2 Within fifteen (15) working days from the date of receiving the documents of the owners, the commune-level People's Committee has a written reply in the form prescribed in Annex 6 of this Circular . Past this deadline, the commune-level People's Committees were consulted without the written comments submitted are considered owners agreed with the owners.

3 Where necessary, prior written reply, the commune-level People's Committees require owners jointly held meetings with representatives of social communities for presentation, discussion, dialogue on environmental protection projects in detail; owners have the responsibility to respond to the request.

4 The following case was not consulted by the commune-level People's Committees:

a) Basis in production, business, services have been centralized competent authority approval of environmental impact assessment or environmental protection project construction phase of infrastructure and manufacturing activities, business planning services appropriate professions in the report set out the environmental impact assessment or environmental projects of production, business and services that focus;

b) facilities located in waters not specifically identified to be responsible for the administrative management of the commune-level People's Committees;

c) Basis of secret elements of security and defense.

Article 7 Authority to evaluate and approve the project environmental protection detail; Permanent evaluation agency for environmental protection project details

1 The competent authority to appraise and approve projects for environmental protection are specified in detail as follows:

a) Ministry of Natural Resources and Environmental appraisal and approval of environmental protection schemes details of the basis of the scale and nature of objects similar to reports of environmental impact assessment regulations in Annex III issued together with Decree No. 29/2011 / ND-CP, except the base elements secret security and defense; appraisal and approval of environmental protection schemes details of the basis of discretion, his approval;

b) Ministry of Defense, Ministry of Public Security appraisal and approval of environmental protection schemes details of the basis of discretion, its approval and other base elements assigned secret security and defense ;

c) The ministries, ministerial-level agencies, government agencies evaluate and approve environmental protection schemes details of the basis of discretion, his approval, except those specified in point a and b, Clause 1 of this Article;

d) the provincial People's Committee for evaluation and approval of projects for environmental protection on the basis of details of their territory, except those specified at Points a, b and c, Clause 1 of this Article.

2 The competent authority to appraise and approve communication agency specialized in environmental protection agency under a permanent work in organizing the evaluation and appraisal of the project approval process detailed environmental protection (hereinafter referred to as Agency standing appraisal). a) To review the validity and completeness of records for appraisal and approval of environmental protection projects in detail;

b) Report by the competent authority and approval of how the appraisal organization with the draft resolution on the establishment of the inspection team of environmental protection at the facility in the form prescribed in Annex 7 attached herewith and a list of agencies, expert opinions (if any);

c) Organization of the inspection team at the facility established by decision of the competent authority for approval; decisions or decisions as suggested by the inspection team of the measurement, sampling and analysis to verify the data;

d) Collect information concerning the basis and environmental protection schemes details of the facility to cater for the evaluation and approval; synthesis and processing of the agency opinion, expert opinion;

e) a written notice to the owner of the evaluation results and the associated requirement to complete the project appraisal documents detailed environmental protection;

e) To review content protection schemes are detailed environmental owners complete and return after appraisal organizations;

g) The draft decision approving the environmental protection details the competent authority for approval consideration and decision;

h) To examine and report to the competent authority for evaluation and consideration for approval to confirm the implementation of environmental protection schemes details of the facility;

i) Perform other tasks related to the evaluation and approval of environmental protection projects in detail at the request of the competent authority for evaluation and approval.

Article 8 The term appraisal of the environmental protection project details

1 Up to forty-five (45) working days from the date of receipt of valid dossiers for environmental protection schemes details of the basis of the scale and nature of the object is equivalent to set alarm assessment of environmental impacts in Appendix III regulations promulgated together with Decree No. 29/2011 / ND-CP.

3 evaluation duration specified in Clauses 1 and 2 of this Article does not include the time that owners complete records as required by the standing agency evaluation of the project evaluation process for environmental protection details.

Article 9: To evaluate and complete the project; preparation and appraisal of the environmental protection project details

1 Check the record: If the dossier is not prescribed, within ten (07) working days from the date of receipt of the application, appraisal permanent body written notice to all basis for improvement. Case records regulations, permanent body appraisal organizations appraisal in accordance with the provisions in paragraph 2, 3 and 4 of this Article.

2 Check the actual environmental effects of the facility:

a) Check the protection of the environment of the facility in accordance with the decision of the inspection team established by the competent authority for approval;

b) Where necessary, the organization measurement, sampling and analysis to verify the data;

c) Making records check in accordance with the form prescribed in Annex 8 of this Circular.

3 Synthesis, processing results consult professionals and agencies involved in environmental protection projects detailed proposal evaluation and approval.

4 Notice of evaluation results (only one time):

Agency Standing appraisal send written notice of appraisal results in a (01) in the third (03) the following cases:

a) The environmental protection plan details passed without modifying the amended;

b) environmental protection plan details be passed to modify conditions, together with the additional requirements specific modifications and supplements;

c) environmental protection plan details are not passed (the reason).

5 After receiving notification of results of the evaluation, the owners are responsible for:

a) For projects that protect the environment through the details need not be modified, added: Signed in the bottom left corner of each page of the proposal, and Replication bound, with cover and cover page in form in Appendix 4 of this Circular quantities to meet the requirements in paragraph 2 of Article 11 of this Circular and sent to the standing committee to consider the evaluation, approval process;

b) For projects that protect the environment through detailed requirements modified, added, modified and supplemented in accordance with project requirements and signed, cloning, closed book as specified in clause 5 this; send (only a single time) all quantities of this proposal, and one (01) copies on a CD accompanied by a written explanation of modifications and supplements to the project appraisal permanent body for consideration and approval;

c) For projects that protect the environment is not passed details: Repeat proposal and submit it to the competent authority and approval for examination.

6 Preparation and evaluation of the environmental protection project details:

a) The facility shall make the environmental protection project details and send dossiers of application for re-examination in accordance with the scheme of Article 5 of this Circular;

b) The term appraisal process to be carried out under the provisions of Article 4, Article 8 of this Circular.

Article 10: To approve the project environmental protection details

1 The time limit for approving the details of environmental protection:

a) A maximum of fifteen (15) working days from the date of receipt of the environmental protection project was complete details as required on the basis of the size and nature of objects similar to the reporting environmental impact assessment regulations in Annex III issued Decree No. 29/2011 / ND-CP;

b) A maximum of ten (10) working days from the date of receipt of the environmental protection project was complete details of the owners of establishments not subject to the provisions in paragraph 1 of this Article ;

c) Time limit for approval prescribed at points a and b of paragraph 1 of this Article does not include the time that owners complete records as required by the competent authority, approval or standing body evaluation in the process of reviewing, approving the details of environmental protection.

2 Decision approving the details of environmental protection in the form prescribed in Appendix 9 to this Circular.

Article 11 Verification and send the project details of environmental protection

1 After the decision approving the environmental protection details, appraisal permanent body to endorse the back of the cover page of the proposal in the form prescribed in Annex 10a is attached herewith .

2 After authentication, appraisal permanent body send and store environmental protection projects as requested details as follows:

a) For environmental protection projects in detail by the Ministry of Natural Resources and Environment approved: Send accompanying the decision approving the environmental protection project details and approved certification for a facility owner (01 ) the Department of Natural Resources and Environment, where the production, sales and service of a base (01) copies a line ministries (01) copies, save one (01) copies;

b) For the protection of the environment project details by the Ministry of Defense, Ministry of Public Security for approval: The decision to send the project approval and environmental protection details shall comply with its own regulations;

c) With respect to environmental protection projects in detail by ministries, ministerial-level agencies, agencies attached to the Government for approval: Send accompanying the decision approving the environmental protection project details approved and certified for owners of a (01) the Department of Natural Resources and Environment in implementing production, sales and service of a base (01) of the Ministry of Natural Resources and the Environment (01) copies, save one (01) copies;

d) With respect to environmental protection projects detailed by the provincial People's Committee for approval: Send accompanying the decision approving the environmental protection project details and approved certification for a facility owner (01 ) the Department of Natural Resources and the Environment (01) copies to the district People's Committee where the production, sales and service of a base (01) copies, save one (01) copies; send the decision approving the environmental protection details for Natural Resources and Environment Ministry, line ministries and People's Committees of communes where production implementation, business services each facility where a (01) copies.

3 Department of Natural Resources and Environment of the Province corpus decision approving the environmental protection detail by ministries, ministerial-level agencies, government agencies inbound to the district People's Committee, commune People's Committee where the production, business and service establishments.

Chapter III

INSPECTION AND CERTIFICATION SCHEME FOR IMPLEMENTATION OF ENVIRONMENTAL PROTECTION DETAIL

Article 12 Responsibilities of owners in implementing environmental protection projects detailed

1 Strict implementation of content protection schemes environmentally approved details.

2 After completion of the project, environmental protection measures, owners filing proposed test and certify the implementation of environmental protection projects in detail and submitted to the competent authority evaluation approval has approved the proposal for environmental protection details to check and certify the performance. The dossier includes:

b) In (05) reported the results of environmental protection schemes details of the facility in the form prescribed in Appendix 12 of this Circular. For establishments mining activities carried out in the form prescribed in Appendix 13 of this Circular. For the base of operations for irrigation and hydropower reservoirs comply with the form prescribed in Appendix 14 of this Circular.

3 For disposal facilities for hazardous waste, the inspection and certification of the implementation of environmental protection projects shall comply with the detailed provisions of the law on hazardous waste management.

Article 13 The responsibilities and deadlines to confirm the implementation of environmental protection projects detailed

1 The competent authority to appraise and approve the provisions of paragraph 1 of Article 7 of this Circular shall:

a) assign permanent body organizing the appraisal review records and inspect the implementation of environmental protection schemes details of the facility;

b) To consider and certify the completion of the implementation of the project environmental protection detail for facilities specified in paragraph 1 of Article 3 of this Circular (hereinafter referred to as certificate of completion).

2 Time limit for completion certificate is specified as follows:

a) A maximum of twenty-five (25) working days from the date of receipt of a valid application for environmental protection schemes details of the basis of the scale and nature of objects similar to the reporting environmental impact assessment regulations in Annex III issued Decree No. 29/2011 / ND-CP;

b) A maximum of twenty (20) working days from the date of receipt of a valid application for environmental protection schemes details of the facility are not subject to provisions of this clause;

c) confirmation deadline specified in point a and b of this paragraph does not include the time that owners complete records as required by the standing body evaluation.

Article 14 Inspection and certification of the implementation of environmental protection project details

1 If the dossier is not prescribed, within a period not exceeding five (05) working days from the date of receipt of the dossier, evaluation of permanent body with a written notice that the facility owner to complete adjustment.

2 Where the prescribed documents, the competent authority for evaluation and approval are responsible for the decision to establish the inspection team in the form prescribed in Appendix 15 attached herewith at the request of the agency permanent evaluation.

Chapter IV

ESTABLISHMENT AND REGISTRATION OF ENVIRONMENTAL PROTECTION SCHEME SIMPLE

Article 15 The establishment must draw up plans to protect the environment simply

1 The establishment must establish environmental protection schemes simple scale, equivalent properties subject to make a commitment to environmental protection provisions of Article 29 of Decree No. 29/2011 / ND-CP, include:

a) there is no basis in the following documents: certificate of registration of environmental standards, certification of registration of environmental protection commitment, written notice of the refusal to register the pledge environmental protection, the registration certificate of environmental protection projects;

b) Basis had one of the following documents: certificate of registration of environmental standards, certification of registration of environmental protection commitment, written notice of the refusal to register the pledge environmental protection, the renovation and expansion, increasing the capacity of the subject to make registration of environmental standards, a commitment to environmental protection supplement (before Decree No. 29/2011 / ND CP effect) or subject to repeated commitments to protect the environment (as stipulated in Decree No. 29/2011 / ND-CP), but there is no certificate of registration of environmental standards or the certificate is committed to protecting the environment or additional written notice of the refusal to register is committed to protecting the environment has now completed the renovation, expansion, increase capacity;

c) Basis already registered certification scheme for environmental protection, while improving, expanding, increasing the capacity of the subject to make environmental commitments supplement (prior to Decree No. 29 / 2011 / ND-CP effect) or subject to repeated commitments to protect the environment (as stipulated in Decree No. 29/2011 / ND-CP), but there is no certificate of commitment environmental protection or additional written notice of the refusal to register is committed to protecting the environment has now completed the renovation, expansion, increase capacity;

d) Basis already registered certification scheme for environmental protection simple when renovating, expanding, increasing the capacity of the subject to make environmental commitments but no written notice of accepting registration of environmental protection commitment which has now completed the renovation, expansion, increase capacity;

e) Facility has commenced and is in the preparation stage (site preparation), has completed the preparation stage and are in the construction phase but not yet written notice of the refusal to register a commitment to environmental protection or registration certificate of environmental protection projects simple.

2. basis specified in paragraph 1 of this Article shall make environmental protection schemes simply defined in this Circular and the sending district-level People's Committees for consideration and confirmation.

Article 16 The process of establishment, registration and certification of registration of environmental protection schemes simple

Establishment, registration and certification of registration of environmental protection schemes follow a simple procedure in Appendix 18 of this Circular, including the following steps:

1. basis of the provisions of Clause 1 of Article 15 of this Circular up and send dossiers of application for registration of environmental protection projects simply defined in Article 17 of this circular to the district People's Committee.

Article 17: Prepare, submit dossiers for registration of environmental protection projects simple

Facility owner liable to draw up plans to protect the environment simply is responsible for:

1 Make or hire consultants to draw up plans to protect the environment simple. The structure and content of the environmental protection project is simply defined as follows:

a) For establishments subject to the establishment of investment projects that have properties of scale, capacity is not on the list or under the provisions of Annex II lists issued together with Decree No. 29/2011 / ND-CP shall comply with the provisions of Annex 19a enclosed with this Circular;

b) For establishments not subject to the establishment of investment projects, but waste from the production process and business, services performed as prescribed in Appendix 19b attached herewith.

2 Send by mail or submitted directly to the registration records of environmental protection projects simple at the district-level People's Committees in implementing production, business and service establishments; case basis lies in the area of two (02) units or more district administration, owners choose one (01) units of the district administration to send registration documents; registration dossier including:

a) A (01) of all documents in the prescribed form basis in Appendix 20 of this Circular;

b) In (05) the environmental protection schemes are simple bound, with cover and cover page in the form prescribed in Appendix 21 of this Circular; Where necessary at the request of the district People's Committee, the owners are responsible for sending additional number of environmental protection projects simple request.

Article 18: Competence, confirm registration deadline environmental protection schemes simple; Permanent registration agencies

1 district People's Committee is responsible for organizing the registration of environmental protection schemes and simple review, grant a certificate of registration of environmental protection projects simpler for owners (hereinafter the certificate).

2 Time limit for issuing a certificate:

a) A maximum of thirty (30) working days from the date of receipt of a valid application for environmental protection projects of the simple facility located in the area of two (02)-level administrative units higher levels;

b) A maximum of twenty (20) working days from the date of receipt of a valid application for environmental protection projects of the simple facility located in the area of the (01) district-level administrative units ;

c) The time limit specified at Points a, b, Clause 2 of this Article does not include the time that owners complete records as required by the registration authority standing in the review process records.

Article 19 Review, complete documents, grant a certificate of registration of environmental protection projects simple; establishment and registration of the environmental protection projects simple

1 Check the record: Where improper records, for a period not exceeding five (05) working days from the date of receipt of the application, the permanent authority to register a written notice to all basis for completion. Case records regulations, permanent body registration review and evaluation, the district-level People's Committees shall certify the registration of environmental protection schemes simple as prescribed in Clause 2, Clause 3 this.

Chapter III

INSPECTION AND CERTIFICATION SCHEME FOR IMPLEMENTATION OF ENVIRONMENTAL PROTECTION DETAIL

Article 12 Responsibilities of owners in implementing environmental protection projects detailed

3 For disposal facilities for hazardous waste, the inspection and certification of the implementation of environmental protection projects shall comply with the detailed provisions of the law on hazardous waste management.

Article 13 The responsibilities and deadlines to confirm the implementation of environmental protection projects detailed

1 The competent authority to appraise and approve the provisions of paragraph 1 of Article 7 of this Circular shall:

a) assign permanent body organizing the appraisal review records and inspect the implementation of environmental protection schemes details of the facility;

b) To consider and certify the completion of the implementation of the project environmental protection detail for facilities specified in paragraph 1 of Article 3 of this Circular (hereinafter referred to as certificate of completion).

2 Time limit for completion certificate is specified as follows:

Chapter IV

ESTABLISHMENT AND REGISTRATION OF ENVIRONMENTAL PROTECTION SCHEME SIMPLE

Article 15 The establishment must draw up plans to protect the environment simply

Article 17: Prepare, submit dossiers for registration of environmental protection projects simple

3. Ủy ban nhân dân cấp huyện xác định cơ quan chuyên môn về bảo vệ môi trường của mình để giúp và làm thường trực trong việc tổ chức đăng ký, xác nhận đăng ký đề án bảo vệ môi trường đơn giản (sau đây gọi là cơ quan thường trực đăng ký).

Điều 19. Xem xét, hoàn chỉnh hồ sơ, cấp giấy xác nhận đăng ký đề án bảo vệ môi trường đơn giản; lập và đăng ký lại đề án bảo vệ môi trường đơn giản

1. Kiểm tra hồ sơ: Trường hợp hồ sơ chưa đúng quy định, trong thời hạn không quá năm (05) ngày làm việc, kể từ ngày nhận được hồ sơ, cơ quan thường trực đăng ký có văn bản thông báo cho chủ cơ sở biết để hoàn chỉnh. Trường hợp hồ sơ đúng quy định, cơ quan thường trực đăng ký tổ chức xem xét, đánh giá, trình Ủy ban nhân dân cấp huyện xác nhận đăng ký đề án bảo vệ môi trường đơn giản theo quy định tại khoản 2, khoản 3 Điều này.

2. Xem xét, đánh giá đề án bảo vệ môi trường đơn giản: Cơ quan thường trực đăng ký tổ chức xem xét, đánh giá đề án; trường hợp cần thiết, tổ chức đoàn kiểm tra đến khảo sát, kiểm tra thực tế tại cơ sở, mời chuyên gia viết nhận xét về đề án, xin ý kiến của Ủy ban nhân dân cấp huyện có liên quan (trường hợp địa điểm của cơ sở có nằm trên địa bàn của đơn vị hành chính cấp huyện khác) để đánh giá đề án; có văn bản thông báo cho chủ cơ sở biết một trong hai (02) trường hợp sau đây (chỉ một lần duy nhất):

a) Đề án bảo vệ môi trường đơn giản phải chỉnh sửa, bổ sung để được cấp giấy xác nhận đăng ký, kèm theo yêu cầu cụ thể về việc chỉnh sửa, bổ sung;

b) Đề án bảo vệ môi trường đơn giản không đủ điều kiện cấp giấy xác nhận đăng ký (nêu rõ lý do).

3. Đối với đề án bảo vệ môi trường đơn giản không phải chỉnh sửa, bổ sung hoặc đã được chủ cơ sở chỉnh sửa bổ sung theo đúng yêu cầu, Ủy ban nhân dân cấp huyện cấp giấy xác nhận đăng ký đề án bảo vệ môi trường đơn giản theo mẫu quy định tại Phụ lục 22 kèm theo Thông tư này.

4. Đối với đề án bảo vệ môi trường đơn giản không đủ điều kiện cấp giấy xác nhận đăng ký, chủ cơ sở có trách nhiệm lập lại đề án bảo vệ môi trường đơn giản và gửi Ủy ban nhân dân cấp huyện để đăng ký lại theo quy định tại Điều 17 và Điều 18 Thông tư này.

Điều 20. Chứng thực và gửi đề án bảo vệ môi trường đơn giản

1. Sau khi đề án bảo vệ môi trường đơn giản đã được đăng ký, cơ quan thường trực đăng ký chứng thực vào mặt sau của trang phụ bìa của đề án bảo vệ môi trường đơn giản theo mẫu quy định tại Phụ lục 10b kèm theo Thông tư này.

2. Cơ quan thường trực đăng ký có trách nhiệm gửi và lưu đề án bảo vệ môi trường đơn giản đã chứng thực theo yêu cầu như sau:

a) Trường hợp địa điểm của cơ sở nằm trên địa bàn của một (01) đơn vị hành chính cấp huyện: Gửi giấy xác nhận đăng ký kèm theo đề án bảo vệ môi trường đơn giản đã chứng thực cho chủ cơ sở một (01) bản, Sở Tài nguyên và Môi trường một (01) bản, Ủy ban nhân dân cấp xã nơi có địa điểm của cơ sở một (01) bản, lưu một (01) bản;

b) Trường hợp địa điểm của cơ sở nằm trên địa bàn của từ hai (02) đơn vị hành chính cấp huyện trở lên: Ngoài việc gửi và lưu như quy định tại điểm a khoản này, còn phải gửi giấy xác nhận đăng ký kèm theo đề án bảo vệ môi trường đơn giản đã chứng thực cho Ủy ban nhân dân cấp huyện khác nơi có địa điểm của cơ sở mỗi nơi một (01) bản.

Điều 21. Trách nhiệm của chủ cơ sở sau khi đề án bảo vệ môi trường đơn giản được đăng ký

Sau khi đề án bảo vệ môi trường đơn giản đã được xác nhận, chủ cơ sở có trách nhiệm như sau:

1. Thực hiện đúng, đầy đủ các nội dung của đề án bảo vệ môi trường đơn giản đã được đăng ký.

2. Trong giai đoạn chuẩn bị, giai đoạn thi công xây dựng, giai đoạn vận hành, cơ sở quy định tại khoản 1 Điều 15 Thông tư này có thay đổi quy mô, công suất, công nghệ và các thay đổi khác có liên quan đến vấn đề môi trường mà phần nội dung cũ và phần nội dung thay đổi đó có quy mô, tính chất tương đương với đối tượng phải lập báo cáo đánh giá tác động môi trường theo quy định của Nghị định số 29/2011/NĐ-CP thì chủ cơ sở phải thực hiện lập báo cáo đánh giá tác động môi trường theo quy định pháp luật về đánh giá tác động môi trường.

3. Trong giai đoạn chuẩn bị, giai đoạn thi công xây dựng, giai đoạn vận hành, cơ sở quy định tạikhoản 1 Điều 15 Thông tư này có thay đổi quy mô, công suất, công nghệ và phải lập dự án đầu tư tương đương với đối tượng quy định tại mục a khoản 1 Điều 17 của Thông tư này thì phải lập đề án bảo vệ môi trường đơn giản theo quy định tại Thông tư này.

4. Trong giai đoạn chuẩn bị, giai đoạn thi công xây dựng, giai đoạn vận hành, cơ sở quy định tạikhoản 1 Điều 15 Thông tư này có thay đổi quy mô, công suất, công nghệ và các thay đổi khác có liên quan đến vấn đề môi trường nhưng chưa đến mức phải lập báo cáo đánh giá tác động môi trường theo quy định của Nghị định số 29/2011/NĐ-CP phải có văn bản báo cáo Ủy ban nhân dâncấp huyện đã cấp giấy xác nhận đăng ký đề án và chỉ được thực hiện các thay đổi đó sau khi cơ quan này có văn bản chấp thuận.

Chapter V

TỔ CHỨC THỰC HIỆN VÀ ĐIỀU KHOẢN THI HÀNH

Điều 22. Điều khoản chuyển tiếp

Đối với hồ sơ đề nghị phê duyệt hoặc xác nhận đề án bảo vệ môi trường được thực hiện theo quy định của Thông tư số 04/2008/TT-BTNMT ngày 18 tháng 9 năm 2008 của Bộ Tài nguyên và Môi trường hướng dẫn lập, phê duyệt hoặc xác nhận đề án bảo vệ môi trường và kiểm tra, thanh tra việc thực hiện đề án bảo vệ môi trường nhưng chưa được phê duyệt hoặc xác nhận, Sở Tài nguyên và Môi trường hoặc Phòng Tài nguyên và Môi trường có trách nhiệm trả lại hồ sơ, hướng dẫn chủ cơ sở lập đề án bảo vệ môi trường chi tiết hoặc đề án bảo vệ môi trường đơn giản để gửi cơ quan có thẩm quyền thẩm định, phê duyệt hoặc tổ chức đăng ký theo quy định tại Thông tư này.

Điều 23. Tổ chức thực hiện

1. Tổng cục Môi trường là cơ quan thường trực thẩm định đề án bảo vệ môi trường chi tiết của Bộ Tài nguyên và Môi trường.

2. Các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ chỉ định cơ quan chuyên môn trực thuộc làm cơ quan thường trực thẩm định đề án bảo vệ môi trường chi tiết của mình và có hình thức thông báo rộng rãi trên phạm vi cả nước.

3. Ủy ban nhân dân cấp tỉnh giao Sở Tài nguyên và Môi trường làm cơ quan thường trực thẩm định đề án bảo vệ môi trường chi tiết của mình và có hình thức thông báo phù hợp.

4. Ủy ban nhân dân cấp huyện giao cơ quan chuyên môn trực thuộc làm cơ quan thường trực đăng ký của mình và có hình thức thông báo phù hợp.

5. Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân cấp tỉnh, Ủy ban nhân dân cấp huyện có trách nhiệm thực hiện chế độ báo cáo về hoạt động thẩm định, phê duyệt và kiểm tra, xác nhận việc thực hiện đề án bảo vệ môi trường chi tiết; hoạt động đăng ký, xác nhận đăng ký đề án bảo vệ môi trường đơn giản theo quy định tại Điều 38 Nghị định số 29/2011/NĐ-CP và theo mẫu quy định tại các Phụ lục 23, 24, 25 kèm theo Thông tư này.

Điều 24. Điều khoản thi hành

1. Bộ trưởng, thủ trưởng cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các cấp tổ chức thực hiện Thông tư này.

2. Thông tư này có hiệu lực thi hành kể từ ngày 02 tháng 5 năm 2012 và thay thế Thông tư số 04/2008/TT-BTNMT ngày 18 tháng 9 năm 2008 của Bộ Tài nguyên và Môi trường hướng dẫn lập, phê duyệt hoặc xác nhận đề án bảo vệ môi trường và kiểm tra, thanh tra việc thực hiện đề án bảo vệ môi trường.

3. Trong quá trình thực hiện Thông tư này có phát sinh những khó khăn, vướng mắc, các Bộ, ngành, địa phương, tổ chức, cá nhân kịp thời phản ánh về Bộ Tài nguyên và Môi trường để hướng dẫn hoặc sửa đổi, bổ sung cho phù hợp./.
